(A) not having the normal use ofmental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or
(B) having an alcohol concentration of 0.08 or more.
This means that even if you blow below a .08, you can still be arrested if you lack the normal use of your physical or mental faculties. This can be evidenced by the way you answer questions, and how you perform on a field sobriety test, among other things. BUT juries and even many judges often dislike convicting drivers of Driving While Intoxicated without seeing proof that you failed a breath test. So if you blow below a .08, your chances of having the case dismissed are much higher and it presents the perfect opportunity for a DWI attorney to be on your side, pushing to get your record cleared. Salek & Garcia are the right DWI lawyers to help you overcome the limited evidence of your intoxication, and they are the right DWI lawyers to help you convince a jury that your breath test proves that you should not be convicted! Give us a call at 512 89 89 DWI and we will discuss how the DWI Team can help you get passed your charges.
